Ding Babb Law Group attains an abnormally fast family petition success!

We recently helped a couple (U.S. citizen petitioner, out-of-status spouse beneficiary) with a marriage petition and we received an unusually fast positive response on the alien beneficiary’s green card. The client also applied for an expedited work card and was approved. We believe our success here was achieved by extensive disclosure of the couple’s relationship details and a hyper-organized submission by our lead family-based immigration attorney, Lin Ding.

The timeline for this application was:

  • Submission time: January 10, 2022;

  • Received by USCIS: January 11, 2022;

  • Immigration Department Fingerprint Notice: January 22, 2022;

  • Customer fingerprinting: February 16, 2022;

  • Customer Expedited Work Card and Re-entry Paper Application Submission: April 1, 2022;

  • USCIS Approves Work Cards and Re-entry Papers: April 15, 2022;

  • Interview date: April 21, 2022;

  • USCIS approves green card: April 28, 2022!

This year's marriage green card approval speed is significantly faster than last year. Most of our clients' green card approval time is between 8 months and 12 months. Although we are very happy for the client, the green card approval case in the above three months is a special case and is not typical. Different applications have different processing times, and that varies again by which USCIS office center is reviewing the submission. Given all those factors, we felt it was still important to highlight the success that was achieved mostly because of the expertly crafted submission by Lin and her team. While the above timeline is not typical, we believe her level of organization led to markedly faster results within a system that is generally slow and backlogged.
