Ding Babb Law Group receives another fast and positive result for a client on a marriage petition green card.
Ding Babb Law Group recently helped a couple (U.S. citizen petitioner, out-of-status spouse beneficiary) with a marriage petition and we received another fast positive response on the alien beneficiary’s green card.
After dating for three years, the beneficiary and her fiancé moved from California to Texas in 2022. They married in October of 2022. We prepared their package in December and submitted both the I-130 and I-145 on January 6, 2023.
Our law firm worked with both the beneficiary and the petitioner to prepare detailed supporting documents showing the authenticity of their marriage. The result of that work and preparation was a smooth and quick wait time. Our clients received no Requests for Evidence (RFE) and the interview was waived. They received approval of the green card application on April 26, 2023.
We were thrilled about this result because, in addition to it being a fast result for our client, processing times at USCIS have been getting longer rather than shorter. Although USCIS has tried to speed up the processing of marriage green cards by canceling interviews when appropriate, processing times have still increased.
After the application is submitted to USCIS, the processing speed is out of our control. There are things we can do before submission in order to hopefully speed up the process: submit extensive and well organized evidence and attempt–if grounds exist–to expedite a travel document or work permit. Sometimes asking EMMA can help expedite the process. However, after a petition for a relative/spouse has been filed, processing is entirely within the discretion of USCIS.
