Important H-1B Visa Cap Dates to Consider

The H-1B Visa is a nonimmigrant employment-based classification applicable to foreign individuals who wish to work in a specialty occupation in the United States. On January 27, 2023, the United States Citizenship and Immigration Services (“USCIS”) published information regarding the Fiscal Year 2024 H-1B Visa process.

The following dates are important to note for any employer or employee in the H-1B process: 

  • February 21, 2023

    • Registrants may create new accounts on USCIS.gov;

  • March 1, 2023

    • Registration period opens at noon eastern. Employer petitioners and employee beneficiaries may enter and submit their information. 

  • March 17, 2023

    • Registration will close at noon on March 17, 2023. On that day, USCIS will randomly select registered individuals. 

  • March 31, 2023

    • USCIS will notify registered individuals regarding their selection. 

If selected, petitions may be submitted from April to June 2023.  H-1B status will generally become active by October 1, 2023. 

We advise our clients and potential clients to identify possible registrants and finalize prospective or current employee registrants before February 21, 2023.
